License A non-exclusive, non-transferable license is provided to use the game "Warshot" on an "as is" basis within the functionality defined by the developer. 2. Payments and Refunds 2.1. The game is Free‑to‑Play, but contains in-game purchases for real money. 2.2. The Copyright Holder does not refund funds for in-game purchases, except in cases expressly provided for by the legislation of the Russian Federation (in particular, the Law of the Russian Federation "On Consumer Rights Protection") or in case of a significant violation on the part of the Copyright Holder (for example, the paid item does not work due to the fault of the server). 2.3. Loot boxes (cases): The chances of dropping items are indicated in the interface. The User is aware that receiving a specific item is not guaranteed, but this does not release the Copyright Holder from the obligation to provide reliable information about the probability of loss in accordance with the procedure established by law. 3. Anti-Cheat (Easy Anti-Cheat) 3.1. The game uses the Easy Anti-Cheat (EAC) protection system. 3.2. When the game is started for the first time, the user is shown a separate information window with a clear description that the EAC scans the RAM, running processes and system files of the device in order to detect cheating software. EAC does not collect personal data (passwords, documents, browser history). 3.3. Consent to EAC's work must be expressed by actively checking the appropriate checkbox and clicking the "Agree" button. Tacit consent (continued launch) is not allowed. 3.4. Refusal to provide consent for scanning makes it impossible to launch the game, due to the technical need to ensure a fair gaming environment. 4. Prohibited actions It is prohibited to: use cheats, bots, modifications (including any changes to game files not provided for by the developer); exploiting errors (exploits) in order to gain an advantage; transfer of the account to third parties; any other actions that violate fair game mechanics. 5. Ban and appeal 5.1. For the use of cheats and other prohibited means (upon confirmation of the violation), permanent account blocking is applied without refund for in-game purchases. 5.2. The User has the right to file an appeal within 7 (seven) calendar days from the moment of blocking to the address [email protected] . The review period is up to 10 (ten) business days. 5.3. The decision taken based on the results of the internal appeal procedure is final for the purposes of restoring access to the game, however, it does not limit the user's right to appeal to the court or authorized state bodies in accordance with the procedure established by the legislation of the Russian Federation. 6. Chat Rules 6.1. In the game chat (text and voice), it is prohibited: insults, spam, incitement to hatred for any reason, broadcasting someone else's audio material without rights, creating noise interference. 6.2. Violation of the chat rules entails the imposition of a mutation or blocking of the chat for up to 30 days. 6.3. Voice chat may be recorded for moderation purposes – detailed conditions are set out in a separate Voice Data Policy, which is an integral part of this Agreement. 7. Responsibility 7.1. The game is provided "as is". The copyright holder is not responsible for delays, errors, loss of data or consequential damages incurred during the use of the game, except in cases provided for by applicable law. 7.2. The Copyright Holder is not responsible for damage to the equipment caused by the correct operation of the EAC system. If it is proved that the damage was caused by a software defect, liability is determined in accordance with Article 1064 of the Civil Code of the Russian Federation and other norms on compensation for damage. 8. Age restrictions The game has an age tag of 16+. By launching the game and accepting the terms of the Agreement, the user confirms that he has reached the specified age. Users under the age of 16 can use the game only with the consent of their legal representatives. For the purposes of processing biometric data (voice), the requirements set out in the Voice Data Policy are additionally applied. 9. Changes to Terms and Conditions 9.1. The Copyright Holder reserves the right to amend this Agreement. 9.2. Changes that do not affect the essential rights and obligations of users (technical, editorial changes) come into force from the moment they are published on the official website of the game. 9.3. Significant changes (the introduction of a paid subscription, new significant restrictions, changes in the processing of personal data) take effect only after receiving the user's explicit consent by clicking the "Accept" button in the game interface. 10. Applicable Law and Dispute Resolution 10.1. This Agreement is governed by the laws of the Russian Federation. 10.2. Mandatory provisions of the Law of the Russian Federation "On Consumer Rights Protection", Federal Law No. 152‑FZ "On Personal Data" and other regulatory legal acts apply to users from the Russian Federation regarding consumer rights protection. 10.3. All disputes and disagreements arising out of or in connection with this Agreement are subject to resolution in court at the location of the Copyright Holder (Nyagan) in compliance with the mandatory claim procedure (the claim review period is 10 working days), unless otherwise established by law to protect consumer rights. 11. Acceptance of the Terms Clicking the "Accept" / "Play" button (or a similar control) in the game interface means that the user has read the terms of this Agreement, fully accepts them, and also gives separate consent to the operation of the EAC system in accordance with paragraph 3.
